Pancast Alüminyum A.Ş. Law on the Protection of Personal Data (KVVK Clarification Text)

1. Identity of the Data Controller

Pancast Alüminyum A.Ş. (“the Company”) emphasizes the protection of personal data and takes all the administrative and technical measures to ensure the security of such data as per the Law No. 6698 on the Protection of Personal Data (“KVKK”). This Clarification Text has been prepared for information purposes as per Article 10 of the KVKK in relation to the ersonal data processed by Pancast Alüminyum A.Ş. 

1. Processed Personal Data

The personal data processed by our Company are as follows according to their data categories:

• Identification: Name, Surname, Turkish ID Number, Date of Birth, Passport Information, Signature.
• Communication Information: Telephone Number, Address, Email Address.
• Financial Information: Bank account numbers, IBAN, salary information.
• Professional Information: Education information, job title, work experience, certificates.
• Audiovisual Data: Camera recording, photograph.
• Legal Action Information: Court and execution information.
• Physical Location Security Information: Camera recordings, entry-exit information.
• Operational Security Information: IP Address, Logs.

1. Personal Data Processing Purposes

Your personal data is processed with the following purposes:

• For our company to conduct its commercial activities;
• The execution of human resources processes (employment, employee files, payroll transactions, etc.);
• Ensuring the security of physical locations;
• Management of customer and supplier relationships;
• Realization of accounting and financial transactions;
• Fulfillment of legal obligations;
• Execution of marketing and communication activities;
• Execution of occupational health and safety activities;
• Execution and performance of contracts;

1. Method of and Legal Reason for Collecting Personal Data

Your personal data is processed:

• Via business contracts, application forms, online platforms, email and other communications channels;
• Through physical forms, agreements and application documents;
• Through web page in electronic media, security cameras and information systems;

As per the legal reasons specified under Articles 5 and 6 of the KVKK.

The legal basis for the processing of your personal data is as follows:

• If stipulated clearly by the laws;
• If necessary for the execution or performance of an agreement;
• Fulfillment of legal obligations;
• If the relevant person has given clear consent;
• If the data processing is necessary within the scope of our company’s legitimate interests.

1. Transfer of Personal Data

Based on the above purposes, your personal data may be transferred to:

• Public organizations and institutions that are authorized by law (tax offices, SSI, courts, etc.);
• Business partners and suppliers;
• Group companies;
• Competent authorities in case of legal disputes;
• Other persons and organizations that are authorized as per the legislation.

1. Rights of the Personal Data Owners

As per Article 11 of the KVKK, the data owners may apply to our Company and shall have the following rights:

• Learning whether your personal data is processed;
• If processed, requesting information regarding the same;
• Learning the purpose of processing personal data and whether the same is used for its intended purpose;
• Knowing the domestic or overseas third parties to which the personal data is transferred;
• Requesting correction if the personal data is processed incompletely or erroneously;
• Requesting the deletion or destruction of personal data within the scope of Article 7 of the KVKK;
• Requesting the notification of third parties, to which the personal data is transferred, the deletion, correction or destruction operations;
• Objecting if a consequence against you arises due to the analysis of processed data with exclusively automated systems;
• Requesting the compensation of damages if you incur damages due to illegal processing of your personal data.

1. Application and Communication

You can submit your request regarding your personal data by sending an email to [ik@pancast.com.tr] or in writing to our Company address. Your applications will be evaluated and finalized within the legal deadlines stipulated under the KVKK and the relevant legislation.

1. Retention Duration of Personal Data

Your personal data will be maintained for the durations specified under the relevant legislation or until the data processing purpose ceases to exist. When the process is completed, your personal data will be securely deleted, destroyed or anonymized.
